Terms & Conditions

Introduction

These Terms & Conditions (“Terms”) form a legally binding agreement between Freo Cartridges (ABN 83 348 252 921) (“the Company”, “we”, “us”, “our”) and you, the customer (“the Customer”), as named on any invoice or order. By placing an order with Freo Cartridges, you agree to be bound by these Terms. We may update these Terms at any time without prior notice. Please review them regularly for any changes.

Orders, Pricing & Payment

• Orders can be placed by phone or email. We do not offer online ordering or have a retail storefront. We will confirm product availability and pricing before finalizing your order.

• All prices are subject to change without notice, except for orders already placed and accepted by the Company.

• Payment is required prior to dispatch or pickup from the warehouse, unless you have an approved credit account.

• For approved credit accounts, payment terms are strictly 15 days from the date of invoice. Failure to comply may result in your account being suspended or converted to a cash-only basis.

• Any overdue account payment may incur interest at 1.5% per month until paid in full. In the event of default, you agree to indemnify Freo Cartridges for all costs incurred in recovering overdue amounts, including legal and out-of-pocket expenses.
   

Shipping, Delivery & Returns

• Free shipping is available on most orders over $80 (some exceptions apply). For orders under this amount, shipping fees may apply.

• We offer next day delivery within the Perth region and some regional areas of WA for orders placed by the daily cut-off time, different for deliveries from local and interstate warehouse. Bulky items are excluded from next day delivery and might take around 2-3 working days for some regional areas of WA.

• While we strive to meet next day delivery, delays may occur due to factors beyond our control. We are not liable for any loss resulting from delayed delivery.

• Delivery is made to the address provided by the Customer. Please ensure your details are accurate.

• Pickup is available from our local warehouse by prior arrangement.

• If you return a product for any reason, the original shipping cost we incurred (minimum $12) will not be refunded, even if you received free delivery. We appreciate your understanding.

• Returns are accepted for faulty, incorrect, or damaged products only. Please notify us within 24 hours of delivery. Products must be returned unused, in original packaging, and with all accessories at your own cost for replacement or refund. Change of mind or circumstances returns are not accepted unless otherwise agreed.

• Refunds will be processed only after we receive and inspect the returned product.
   

Account Credit Terms & Overdue Accounts

• By ordering on account, you accept the credit application terms, guarantee, indemnity, and these Terms to the exclusion of all others.

• Overdue accounts may bear interest and may result in suspension of further orders until all outstanding amounts are paid.

• If legal action is required to recover any amounts, you are liable for all associated recovery costs, including legal fees on a solicitor and own client basis.
   

Limitation of Liability & Warranty

• We guarantee our products to be free from defects in material and workmanship under normal use and service.

• Our total liability is limited to the replacement of any defective product. We are not liable for any indirect, special, or consequential loss or damage, including loss of revenue, production, product, contract, or profit, however arising.

• All products are covered by the manufacturer’s warranty or our supplier’s warranty for compatible cartridges.
   

Default & Recovery

• If you default on payment, you indemnify Freo Cartridges against all loss and damage related to recovery action, including solicitors’ fees, bank fees, freight, and insurance.

• Should legal action be necessary, you agree to pay all costs incurred by Freo Cartridges in recovering outstanding amounts.

Privacy

• Your personal information is handled in accordance with our Privacy Policy, available on our website.

Governing Law

• These Terms are governed by the laws of Western Australia. Any disputes will be subject to the jurisdiction of the courts of Western Australia.
